These Terms of Use (the "Terms") set out the conditions under which safa.co (the "Operator") provides the mobile application "Listen & Speak Nepali" (the "App"). By using the App, the user is deemed to have agreed to these Terms.
Article 1 (Scope)
These Terms apply to all relationships between the user and the Operator concerning use of the App.
Article 2 (Use)
The App is available through the Apple App Store or the Google Play Store. The respective terms of those stores also apply alongside these Terms.
The App is free to use. If paid features are added in the future, prior notice will be given within the App or in the store description.
Article 3 (Intellectual property)
All copyrights, trademarks, and other intellectual property rights in the App and in the text, audio, images, design, source code, marks, and any other content contained in the App (collectively, the "Content") belong to the Operator or to the rightful rights-holders.
Beyond private use, the user shall not copy, republish, modify, redistribute, sell, lend, or otherwise use the Content.
Article 4 (Prohibited acts)
When using the App, the user shall not engage in any of the following acts:
- Acts that violate laws, regulations, or public order and morals
- Acts that interfere with the operation of the App
- Acts of reverse-engineering, decompiling, disassembling, or otherwise attempting to analyze the App's source code
- Acts of copying, republishing, modifying, or redistributing the App or the Content without authorization
- Acts that infringe the intellectual property rights, privacy, reputation, or other rights or interests of the Operator or any third party
- Any other acts that the Operator deems inappropriate
Article 5 (Changes and suspension of the App)
The Operator may change the content of the App, or suspend or discontinue the provision of the App, without prior notice to the user. The Operator shall not be liable for any damages incurred by the user as a result.
Article 6 (Disclaimer)
The Operator makes no warranty whatsoever as to the completeness, accuracy, usefulness, or fitness for a particular purpose of the content of the App.
Nepali expressions, translations, and pronunciations included in the App are provided as examples for learning purposes; please understand that usage may vary by region, situation, or speaker.
The Operator shall not be liable for any damages incurred by the user arising from use of, or inability to use, the App. However, this disclaimer does not apply where the agreement between the user and the Operator constitutes a consumer contract under the Consumer Contract Act of Japan.
Article 7 (Privacy)
Handling of personal information and usage data in the App is governed by the separately defined Privacy Policy.
Article 8 (Changes to these Terms)
The Operator may revise these Terms when deemed necessary, without notifying the user. Revised Terms take effect once posted on this page.
Article 9 (Governing law and jurisdiction)
These Terms shall be interpreted and applied in accordance with the laws of Japan. In the event of any dispute between the user and the Operator concerning the App, the court of jurisdiction over the location of the Operator's head office shall have exclusive jurisdiction as the court of first instance.
